Fatal Car Accidents in California
When a loved one dies in a car accident, the pain and suffering can be overwhelming. In addition to the emotional anguish, there are also financial considerations. If the death was caused by someone else's negligence, you may be able to recover damages through a personal injury or wrongful death lawsuit.
In California, the following types of damages may be available:
- Loss of services. This includes the loss of domestic services, such as cooking, cleaning, and child care. It also includes the loss of financial support if the deceased was the breadwinner.
- Loss of companionship. This compensates for the loss of love, affection, and companionship that comes with the death of a spouse or parent.
- Lost earning capacity. This is intended to reimburse for lost wages and future earnings if the deceased was working at the time of death.
- Funeral and burial expenses. These are typically paid by the estate of the deceased but can be recovered from the negligent party in some cases.
