Fatal Car Accidents in California
Every month, over 3,300 individuals tragically lose their lives in automobile accidents across the United States. Regrettably, many of these fatalities occur due to the negligent or reckless actions of others.
If you have lost a loved one in a fatal car accident, there may be legal avenues available to help your family move forward. In California, the California Code of Civil Procedure 377.60 allows various parties to pursue wrongful death claims following the loss of a loved one in such an accident. The entitled parties include:
- The surviving spouse of the decedent
- The surviving children of the decedent
- The surviving parents or siblings of the decedent, and potentially their children
- Any grandparents of the decedent
- Any other individuals who were dependent on the decedent prior to their passing
These entitled parties have the opportunity to seek compensation for wrongful death, aiming to recover financial recompense for some of the damages incurred due to their loss.
Following the loss of a loved one, your family can file for compensation to cover various damages, including:
- Loss of benefits
- Loss of the decedent's future earnings
- Medical expenses of the decedent
- Funeral costs or burial fees
