After losing a loved one due to a fatal car accident, you may be able to file a wrongful death claim against the person who is responsible. First, only certain family members may bring a wrongful death claim. These include the deceased person's spouse, child, or parent. If none of these relatives exist, then a grandparent or sibling may file the claim.
Second, the death must have been caused by someone else's negligence. This means that the other driver was not driving carefully and caused the accident that led to your loved one's death.
Third, you must be able to prove that your loved one's death has resulted in financial damages. This could include funeral and burial expenses, loss of income, and medical bills.
If you believe that you meet these criteria, then you should contact an experienced Riverside wrongful death attorney who can help you through the process of filing a wrongful death case against the responsible party.
