Car Accidents in California
Accidents that involve a lot of vehicles tend to result in serious injuries for those involved. Unfortunately, we see many people injured as a result of driver recklessness. When drivers fail to operate their vehicles in a manner that is safe for others sharing the road, they can cause accidents that severely harm those involved.
After being hurt in an accident, individuals have the ability to seek compensation by filing a personal injury lawsuit against the responsible party. Even though you may know who is at fault for the accident, it is important that you are able to prove it in order to prevail.
To win a personal injury claim following an accident, you must be able to prove that the defendant owed you a duty of care. In California, all licensed drivers are required to operate their vehicles in a manner that is safe for others sharing the road.
When drivers fail to do so, such as when they engage in reckless actions like speeding or drinking, they breach the duty of care. You must demonstrate that the driver at fault for the accident breached the duty of care and caused the accident. After showing that they caused the accident, you must show that you suffered damages.
Damages generally include any financial burdens or physical and emotional pain and suffering that you have as a result of the accident. This can include medical expenses, vehicle repair costs, and even the loss of enjoyment of life.
