Car Accidents in California
If you were injured in a car accident in California, you may be able to recover damages from the at-fault driver by filing a personal injury lawsuit. In order to win your case, you will need to prove that the other driver was negligent and that their negligence caused your injuries.
There are four elements of negligence that must be proven in order to succeed in a personal injury lawsuit: duty, breach, causation, and damages.
- Duty: The defendant (the at-fault driver) owes you a duty of care. This means that they have a responsibility to drive safely and avoid causing accidents.
- Breach: This means that the defendant breached their duty of care by driving unsafely or carelessly. For example, if the defendant was speeding or ran a red light, this would be considered a breach of their duty of care.
- Causation: This means that the defendant's breach of their duty of care must have caused your injuries. If you would have been injured even if the defendant had not breached their duty of care, then they cannot be held liable for your injuries.
- Damages: This means that you must have suffered some type of harm or loss as a result of the defendant's negligence. For example, if you incurred medical bills or lost wages as a result of the crash.
