Fatal Pedestrian Accidents in California
Fatal auto accidents take the lives of thousands of people annually. More than 25% of victims who lose their lives as a result of these accidents are pedestrians. In many cases, these accidents are a result of some form of negligence. Countless pedestrians die in traffic incidents as a result of speeding drivers, drivers who fail to yield, and motorists who are distracted.
When drivers fail to maintain control of their vehicles in a respectful and safe manner, they place the life of everyone else at risk. The unexpected loss of a loved one can have an overwhelming impact on families. Regrettably, many families are left to deal with countless consequences that can be mental, emotional, and financial.
After losing a loved one due to a fatal pedestrian accident, there are several parties who have the ability to file a wrongful death claim against the responsible party. In California, entitled parties can include:
- The decedent’s surviving spouse.
- The surviving children or child of the deceased victim.
- Any dependent minors that were living in their household.
- The parents of the deceased victim.
Additionally, there are three other parties that have the legal ability to file a claim. These can include anyone that is a potential heir under our states into state and succession laws. Generally, this can include siblings, children of the departed siblings, and parents of adults.
