Fatal Pedestrian Accidents in California
In California, hundreds of pedestrians end up losing their lives as a result of car crashes that take place each year. There are many cases when these accidents are a result of negligence.
When innocent people lose their lives as a result of collisions, their families are able to pursue wrongful death claims against the responsible party. In order to prevail, a family must be able to demonstrate that the elements of negligence existed at the time of the crash. These elements include:
- Duty of Care: The defendant owed a duty of care to the deceased person. An example of this would be a situation where a driver has a duty to operate their vehicle safely and follow traffic laws.
- Breach of Duty: The defendant engaged in some action that breached their duty of care. This means that they failed to meet the expected standard of care. For example, if a driver was texting while driving and caused an accident, they would have breached their duty to provide care to the victim.
- Causation: The defendant's breach of the duty of care must have caused the victim’s death. The bereaved family must be able to show that the defendant's actions directly caused the crash that took the life of the victim.
- Damages: The bereaved family must have suffered damages as a result of the deceased person's death. This can include financial losses, such as funeral costs, as well as emotional losses, such as pain and suffering.
To provide your family with the best chance of getting justice, it is crucial that you seek help from a wrongful death lawyer in Los Angeles immediately. Your lawyer will be able to build a case against the defendant and prove that your loved one died due to their negligent actions.
